GENERAL TERMS AND CONDITIONS of Burda Praha, Ltd.

SUBJECT OF GENERAL TERMS AND CONDITIONS 
These conditions govern the rights and obligations of Burda Praha, Ltd., Company ID: 15273598, and all its customers, especially subscribers of magazines published by Burda Praha, Ltd., participants in events and competitions organized by Burda Praha, Ltd., registered and unregistered users of the websites which are operated by Burda Praha, Ltd., and all other persons using its services (hereinafter "Customer") for the provision and use of publicly available services provided by Burda Praha, Ltd.
 
CONDITIONS FOR SUBSCRIBERS 
A customer who is interested in a subscription, which is the periodical sending of magazines published by Burda Praha, Ltd., fills in the subscription order form published in magazines of Burda Praha, Ltd. or in other printed media or in electronic form on the websites of Burda Praha, Ltd. and send it to Burda Praha, Ltd. Order of subscription can be also done by telephone on customer support line of Burda Praha, Ltd. or its business partners or by any other way that Burda Praha, Ltd. determines as a way of order of subscription.
 
For sending of magazines  within the purview of subscription, it is necessary to tell Burda Praha, Ltd. the customer's shipping and billing address. In case of coming of delivery problem, it is necessary to tell Burda Praha, Ltd. other customer's contact information, especially phone number and e-mail address. The customer can inform Burda Praha, Ltd. about other additional information which will contribute to the improvement of services provided by Burda Praha, Ltd.
 
If the customer communicates to Burda Praha, Ltd. his personal data and other personal information according to the subscription order, he gives the consent to the processing of communicated personal data and other contact details including electronic contacts (e-mail, phone, fax etc.). Range of awarded consent, processing rules of customer's personal data and the conditions of their use are described in Part D hereof in more detail.
 
CONDITIONS OF PARTICIPATION IN THE COMPETITIONS 
C.1 Consent to the processing of personal data
 
A customer who is interested in participating in the competition or other event organized by Burda Praha, Ltd., can do that in a way which Burda Praha, Ltd. determines as a way of register into the competition or event, mainly by completing and sending of the printed or electronic form for participation in the competition or event.
 
Participation in the competition or other event is Burda Praha spol. s.r.o. authorized to make the disclosure of personal and other data that are necessary for the assessment of compliance with the conditions for participation in the contest or other event, for the proper evaluation of competitions and other events and for communicating the results of the competition or to send any winnings. If the customer is interested, can Burda Praha spol. s.r.o. disclose certain supplemental information that will contribute to the improvement of services provided by Burda Praha, Ltd.
 
If the customer communicates to Burda Praha, Ltd. his personal data and other personal information according to the competition or the other event, he gives the consent to the processing of communicated personal data and other contact details including electronic contacts (e-mail, phone, fax etc.). Range of awarded consent, processing rules of customer's personal data and the conditions of their use are described in Part D hereof in more detail.
 
C.2 Consent to the use of contributions
 
If the customer provides tangible or electronic materials which are copyrighted pursuant to Act no. 121/2000 Coll., on Copyright Act (especially authorial texts, photographs, drawings, pictures, etc.) (hereinafter the "Contributions") to Burda Praha, Ltd. according to the participation in a competition or other event, he grants to Burda Praha, Ltd. the permission to use of these copyright works by publishing in magazines of Burda Praha, Ltd. and making them accessible via the Internet on the websites operated by Burda Praha, Ltd., furthermore by placing them in print advertisements, posters, billboards, leaflets and similar advertising materials within advertising, marketing or promotional events or campaigns (particularly related to magazines of Burda Praha, Ltd.), including the right to provision of all of the above remits wholly or partly to a third party.
 
In case that contributions will capture the personal attributes of the customer or any third party (especially portraits, pictures, video, audio and audio - visual records regarding the natural persons or their personal expression, etc.), the customer grants to Burda Praha, Ltd. the permission to use of these personal attributes as described above in paragraph 1.8. hereof.
 
The customer grants all the remits according to Article C.2 hereof to Burda Praha, Ltd. without entitlement to any compensation or remuneration (if it is not specified otherwise in terms of specific competition or event) for the whole world, for a period of seventy years and without quantitative restrictions. The customer acknowledges and agrees with that the physical media on which contributions will be recorded (copies, data carriers, VHS tapes, etc.) will not be returned to the customer.
 
If the customer sends Burda Praha, Ltd. his contributions, he confirms the authority to provision of all the rights mentioned earlier in this article of General terms and conditions to Burda Praha, Ltd. and that nobody has any rights to these contributions, which would prevent the customer. If this customer statement will prove to be false, Burda Praha, Ltd. is entitled to require of the customer the compensation for damage and all costs caused by that Burda Praha, Ltd. considers the customer statement as true and used the contributions as described above.
 
Burda Praha, Ltd. reserves the right not to use the contributions, especially if the contributions will be outside the Czech law, morality, will threaten public order or contradict by its content the legitimate interests of Burda Praha, Ltd.
 
CONDITIONS OF PROCESSING AND USE OF PERSONAL DATA
 D.1 consent to the processing of personal data
 
If the customer communicates to Burda Praha, Ltd. his personal data and other personal information according to the use of products and services of Burda Praha, Ltd. (mainly by completing and sending of the printed form for order of subscription or for participation in the competition or event, by completing and sending of the form through the websites, by order of subscription through the telephone, by sending of letter or in another way according to events organized by Burda Praha, Ltd.), he gives the consent to the processing of communicated personal data and other contact details including electronic contacts (e-mail, phone, fax etc.) by Burda Praha, Ltd. The customer grants this consent for an indefinite period, but he is entitled to revoke it at any time by written statement delivered to the address Burda Praha, Ltd.
 
If the customer communicates electronic and telephone contacts to Burda Praha, Ltd., he grants the consent to sending of business communication or promotional materials of Burda Praha, Ltd. or its business partners. If the customer does not agree with the sending of business communication or promotional materials of Burda Praha, Ltd. or its business partners via provided electronic and telephone contacts, he can tick the appropriate column of appropriate form or send an e-mail to the e-mail address zrusenisouhlasu [at] burda.cz or he can report this fact personally on telephone line or he can communicate this fact in written way together with his electronic and telephone contacts.
 
D.2 Purpose and conditions of the processing of personal data
 
Burda Praha, Ltd. declares that it will process and use the data collected under Article D.1 hereof only for the purpose of creating of database of readers of magazines and websites of Burda Praha, Ltd., for the purpose of evaluating of the target groups of readers of particular magazines and websites, for the purpose of evaluating of attendance of websites, for the purpose of evaluating of the competition, sending of subscribed magazines and possible prizes, business communication or promotional materials of Burda Praha, Ltd. or its business partners in the database included persons.
 
Burda Praha, Ltd. declares that the personal data provided by the customer will be processed purely for the needs of the company, and only by the employees of this company or its contractors, and will not be disclosed to any other person. The customer right to access to his personal data is guaranteed.
 
In case that Burda Praha, Ltd. violates its obligations as administrator of personal data under the Act no. 101/2000 Coll., the user has the right to require the explanation of Burda Praha, Ltd. and the elimination of incurred illegal status.
 
FINAL PROVISIONS
 
These General Terms and Conditions become valid and effective as at the date of their publication. The moment of publication is the moment of publishing of General Terms and Conditions in the printed issue of any magazine of Burda Praha, Ltd. or the location of General Terms and Conditions into the footer of the websites of Burda Praha, Ltd. Only Burda Praha, Ltd. is entitled to change or replenish these General Terms and Conditions. Burda Praha, Ltd. is entitled to change General Terms and Conditions at any time. Burda Praha, Ltd. announces a change in the General Terms and Conditions by warning in printed issue of any magazine of Burda Praha, Ltd. or on the websites. The customer expresses the consent to the new General Terms and Conditions by the continuation in using of products and services of Burda Praha, Ltd.
